Visas de inversionista bajo el Tratado de Libre Comercio (NAFTA) agilizan el proceso de inversión para los mexicanos

El 1 de enero de 1994, entró en vigor el Tratado de Libre Comercio (TLC) entre los Estados Unidos, México y Canadá, que afectó directamente al proceso de visas de inversionista para ciudadanos de esos tres países.

El TLC reemplazó el viejo procedimiento que dependía del sistema tradicional que no daba oportunidades de inversión a dichos ciudadanos.  En la actualidad se están otorgando estas visas a empresas y personas que pasan por una rigurosa investigación de seguridad, dispuestos a invertir una cantidad adecuada, por lo menos el 51%, del costo de la inversión. Por ejemplo, si la compra de un restaurante es 300.000$(US), se requiere el pago del 51% que cubriría equipo, muebles, inventario u otros gastos relacionados a dicha inversión.  En el caso de un inversionista mexicano, el dinero sería trasladado desde México a los Estados Unidos vía giros bancarios cuyo propósito es demostrar el origen de los fondos para un propósito legal en los Estados Unidos. The U.S. needs to compete with a rapidly evolving global economy and one way to do it is by absorbing needed foreign workers. Under current conditions, however, U.S. employers must depend on what is commonly known as an outdated and complex “Employment-Based Preference Three” (EB-3) in order to sponsor a skilled or professional alien worker. The greatest disadvantage of EB-3 is quotas that restrict the inflow of vitally needed foreign workers. Translating this into practical terms, there are unreasonable delays in bringing such alien workers to the U.S., for instance, for Mexican workers, the delay is over nine years, and for European workers it is over five years. Es una pregunta que surge después de la victoria del presidente Barack Obama hace dos años cuando teníamos la esperanza de una reforma inmigratoria.  Lo que sigue es esperar los acontecimientos que se avecinan hasta que termine la sesión de las dos Cámaras del Congreso unos días antes de la navidad.  A fines de este año se estará realizando una sesión de transición, en la cual la propuesta de la reforma inmigratoria quizás absorberá la atención del Congreso de los Estados Unidos.  Digo “quizás” porque, hasta la fecha, ninguno de los partidos políticos de este país nos han tomado en serio. Elimination of Birthright Citizenship will Hurt the U.S.

The 2009 Birthright Citizenship Act introduced in the House of Representatives would deny U.S. citizenship to any child born in the U.S. when both parents are unauthorized immigrants.  The Act would reverse 144 years of law, first established in the Civil Rights Act of 1866, which granted U.S. citizenship to all persons born in the U.S. “not subject to any foreign power,” such as in the case of children of diplomats. Why the Dream Act is Good for Us

The Dream Act is a central part of the comprehensive immigration reform legislation proposed by Luis Gutierrez (D-Illinois).  The Act would award legal status to undocumented immigrant children who fall under certain criteria.  Among these criteria, they must have entered the U.S. before the age of 16, have lived here for five years, graduated from high school or received a GED, and either gone to college or enlisted in the military for two years.  According to the American Immigration Lawyers Association (AILA), the Act is “a humane, rational solution to a bedeviling problem: a generation of undocumented kids who are coming of age without any prospects to advance their lot in life.” Read more …

U.S. citizens who are applauding Arizona’s efforts to put a lid on illegal immigration in that state are not thinking things through.  For instance, the probability that we can have 50 different versions of who exactly is an “illegal alien” and what is “reasonable cause.”  I mention this because each state of the United States has its own, distinct culture, as reflected by the clothes we wear and the way we speak.  Each state in the union has a different definition of “foreigner.” It’s possible, if not likely, that my Texas way of speaking, yes, that Texas twang, will irritate someone one day, maybe a New York City cop who doesn’t like Texans anyway, who arrests me for not carrying proof of U.S. citizenship.   Read more …
