In an August 2011 press release, representatives of the U.S. Department of Homeland Security announced initiatives that would promote start-up enterprises and create jobs in the U.S. This was going to be done through a program called Start-Up America, an initiative to promote entrepreneurship in the country. It was started six years ago, but only now seems to be taking the spotlight against the backdrop of increasing unemployment figures and lowered GDP figures. Read more …

In December of last year, the media reported on a U.S. soldier on active duty whose wife and son were barred from returning to the United States when they went to their interview for permanent residence outside of the United States. Like many people, his wife was brought to the U.S. at infancy, by her parents. She had no family in Mexico and the country was foreign to her. Nonetheless, she was barred from returning because of her unlawful presence in the United States in spite of her marriage to an enlisted man. Read more …

The world of immigration consists largely of visa petitions filed with the U.S. Citizenship and Immigration Services (USCIS).  These visa petitions require a qualified individual, known as petitioner, to petition for an eligible alien, known as the beneficiary.  There are two types of beneficiaries: a principal beneficiary, such as the wife of a qualified petitioner, and a derivative beneficiary, such as the child of such petitioner.

The North American Free Trade Agreement (NAFTA) offers Mexican and Canadian professionals the opportunity to work in the United States. The category is known as the “TN visa.”  The TN visa, however, has been widely ignored by U.S. businesses because they became accustomed to the more cumbersome H-1B visa, another category for foreign professional workers.

What U.S. businesses don’t know is that the TN offers many advantages over the H-1B visa.  For instance, the TN visa includes more professions than the H-1B, and there is no time limit whereas the H-1B can be used for up to six years. Es una pregunta que surge después de la victoria del presidente Barack Obama hace dos años cuando teníamos la esperanza de una reforma inmigratoria.  Lo que sigue es esperar los acontecimientos que se avecinan hasta que termine la sesión de las dos Cámaras del Congreso unos días antes de la navidad.  A fines de este año se estará realizando una sesión de transición, en la cual la propuesta de la reforma inmigratoria quizás absorberá la atención del Congreso de los Estados Unidos.  Digo “quizás” porque, hasta la fecha, ninguno de los partidos políticos de este país nos han tomado en serio. Hace varias semanas ICE, la agencia del Departamento de Seguridad encargada de lo que se denomina “removals” (o deportaciones) de personas indocumentadas, expidió una política nueva que permite que ciertas personas que han sido solicitadas y que están a punto de inmigrar, no sean trasladadas a trámites de deportación.  Sin embargo, el propósito del tema de hoy es alertar a los miembros de la comunidad, de lo que quiere decir dicho cambio en política, porque muchos lo han interpretado como una liberación de las iniciativas anti-inmigrantes del gobierno cuando este no es el caso.

La sub-oficina del Servicio de Inmigración en Ciudad Juárez, ha explicado la necesidad de llevar una forma denominada I-601 con evidencia demostrando la urgente necesidad de perdonar violaciones legales anteriores del inmigrante que ha vivido ilegalmente en los Estados Unidos y la necesidad de regresar legalmente para sostener o apoyar a su familia norteamericana, que sufriría una daño extraordinario si dicho inmigrante no regresa. “Daño extraordinario” quiere decir exáctamente eso, un daño tan serio, como el de una esposa norteamericana con problemas cardiacos y diabetes que impiden que ella se sostenga por si sola.  Por cierto, las normas mencionadas no incluyen ningún daño a los hijos norteamericanos del inmigrante porque así fue diseñada la ley por el congreso de los Estados Unidos.  Read more …

Why the Dream Act is Good for Us

The Dream Act is a central part of the comprehensive immigration reform legislation proposed by Luis Gutierrez (D-Illinois).  The Act would award legal status to undocumented immigrant children who fall under certain criteria.  Among these criteria, they must have entered the U.S. before the age of 16, have lived here for five years, graduated from high school or received a GED, and either gone to college or enlisted in the military for two years.  According to the American Immigration Lawyers Association (AILA), the Act is “a humane, rational solution to a bedeviling problem: a generation of undocumented kids who are coming of age without any prospects to advance their lot in life.” Read more …

U.S. citizens who are applauding Arizona’s efforts to put a lid on illegal immigration in that state are not thinking things through.  For instance, the probability that we can have 50 different versions of who exactly is an “illegal alien” and what is “reasonable cause.”  I mention this because each state of the United States has its own, distinct culture, as reflected by the clothes we wear and the way we speak.  Each state in the union has a different definition of “foreigner.” It’s possible, if not likely, that my Texas way of speaking, yes, that Texas twang, will irritate someone one day, maybe a New York City cop who doesn’t like Texans anyway, who arrests me for not carrying proof of U.S. citizenship.   Read more …
